My company suddenly dismissed me and only offered severance pay. But I want to claim my other rights as well; what should I do? Also, how can I protect myself during the dismissal process? Can I also get support from my family?
definitely go
When you mention rights, which rights are you talking about specifically? Overtime or something else?
@caylakadam yes, I’m wondering if I have the right to overtime and unemployment benefits. Also, I was in the notice period, could there be compensation for that?
similar thing happened to me. It doesn’t work without a lawyer, I filed a lawsuit for notice and other receivables outside of my seniority. It was resolved in 1 year.
@soncaykaldi it can be done without a lawyer as well. My friend started with a complaint to ALO 170 and got results.
The reason for termination is important. Is it justified dismissal or arbitrary termination? To learn details such as overtime, vacation pay, in addition to seniority and notice, consult with an employment law attorney with your documents in hand.
@uykuarasi winning the case usually has more serious consequences, I would say it’s not just limited to a complaint.
If you were dismissed without notice, you already have the right to extra compensation. Check your termination document and your SGK records; sometimes they manipulate insurance premiums, and they might unknowingly steal from other rights you have.
Let me ask the first question: what code is written on that termination document? Is it for arbitrary dismissal, performance, or termination? Check that first to see if it leaves room for a lawsuit. If it says something like code 29, that’s a big problem, so act accordingly.
Even if it’s not code 29, if there is a termination code based on the fault of worker 25/2 or another worker, be careful. These will affect their rights, so examine them closely. Even if your exit document is correct, make sure to confirm with İŞKUR for unemployment benefits.
